Fabretti v. Gill, 2014 BCSC 899
Mr. Fabretti was 12 years old and suffered a mild traumatic brain injury, soft tissue injuries to his neck, back and shoulder area with headaches and psychological trauma arising from a catastrophic accident on the Pattullo Bridge.
ICBC denied that Mr. Fabretti suffered significant injuries in the motor vehicle accident and further denied that his subsequent drug addiction was a result of the accident. ICBC ignored the impact of the loss of parental support and guidance he experienced as a result of the serious physical injuries to other members of his family.
ICBC offered $60,000 before trial. The trial judge awarded $517,346.68 for Mr. Fabretti’s injuries and held his drug addiction was “more likely than not” caused by the accident.
